COMMENTS

AMENDMENTS

1898 Code vs. 1973 Code

Rule-making power of High Court – Sections 282 and 283 correspond to sections 543 and 365 of the old Code respectively.

The old section 365 conferred a rule-making power on the High Court, not being a Court of Judicial Commissioner, to prescribe the manner of recording the evidence in cases coming before the court. The corresponding new section 283 confers such a rule-making power on Judicial Commissioners besides the High Court of States. It also covers examination of the accused.
